The ninth circuit court has upheld a ban on deploying state troops in Portland, Oregon, after a latest court ruling.

Appeals Court Concurs to Rehear Legal Matter

The ninth circuit court of appeals decided on Tuesday that it would reexamine the case concerning the president’s authority with an larger group of 11 judges. The court also vacated a previous ruling from a smaller judicial group that had sided with the administration.

Ongoing Dispute Over Troop Deployment

This order represents the most recent development in a protracted court case over whether the administration has the legal right and valid reason to deploy state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in response to ongoing demonstrations.

Differing Viewpoints

The administration has claimed that federal officials at the ICE facility in the southern part of the city were facing threats, while city and state officials maintain that municipal police have control of the situation.

Contrary to descriptions of the city as a conflict zone, residents have been posting footage of scenic paths and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland issued two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in Oregon, after efforts to evade the first order by calling up out-of-state forces.

On Monday, the appeals court had put the first ruling on hold – permitting command of state troops – but the subsequent injunction remained in place, blocking the physical sending of the troops.

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a group of 11 judges.

“This ruling shows that the truth matters and that the judicial system are striving to hold this administration accountable. The founding document restricts the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.

“The court is sending a clear message: the president cannot dispatch the military into American urban areas unnecessarily. We will continue protecting Oregon’s laws, values, and autonomy as this legal proceeding moves forward and our legal battle continues in the judicial system.”
